Terms and Conditions

By purchasing a membership, class pack, or attending a class at MOVA Studios, you agree to be bound by these Terms and Conditions. Please read them carefully before making any purchase. MOVA Studios is operated by MOVA Studios Limited (company number 16535562), registered at First Floor, Hargrave House, Boroughbridge Road, York, YO26 5RX (“we”, “us”, “our”, “the Studio”). “You” and “your” refer to you, the member or customer.
1. Definitions
“Founders Membership” means the discounted membership offered exclusively during the pre-launch and initial opening period of the Studio, subject to a limited number of places and the specific terms set out in Section 3.
“Standard Membership” means any membership other than the Founders Membership, including Unlimited and class-count-based memberships.
“Class Pack” means a pre-paid bundle of classes that may be used within the validity period stated at the time of purchase.
“Billing Date” means the date on which your recurring payment is due, as notified to you at the time of purchase.
“Cooling-Off Period” means the 14-day period beginning on the day after you enter into a membership or subscription contract, during which you may cancel for any reason and receive a full refund less the value of any services already consumed.
2. Memberships and Billing
2.1 Membership Types
We offer the following membership types. Full pricing and billing details are provided at the point of purchase and form part of the pre-contract information you receive before completing your purchase:
•Founders Membership (MOVA Move and MOVA Thrive tiers) see Section 3 for dedicated terms.
•Standard Unlimited Membership billed monthly, providing unlimited class access subject to booking and capacity rules.
•Class Packs pre-paid bundles valid for a specified period from the date of purchase.
2.2 Billing
All memberships are billed in advance on a recurring basis. Your Billing Date is confirmed at the point of purchase. Payments are taken automatically via the payment method you provide at sign-up.
If we change our billing frequency, we will give you at least 30 days’ written notice and you will have the right to cancel without penalty before the change takes effect.
2.3 Minimum Commitment
Founders Memberships are monthly rolling with no minimum commitment period.
Standard Memberships have a minimum commitment period of 3 months from the date of your first payment. If you cancel a Standard Membership before your minimum commitment period has elapsed, an early termination fee will apply. This fee is calculated as the remaining monthly payments due under the minimum commitment period, and will not exceed the total value of the remaining term.
2.4 Pre-Contract Information
Before you complete any purchase, we will provide you with clear information about the total price (including any applicable taxes), the billing frequency, the auto-renewal mechanism, and how to cancel. This information will be presented clearly at the point of purchase, separately from any marketing material.
3. Founders Membership
The Founders Membership is a special rate offered to early members of MOVA Studios, designed to reward those who support the Studio from launch.
3.1 Eligibility and Availability
The Founders Membership is available to a maximum of 50 members. Once this cap is reached, or once the Studio opens (whichever is earlier), no further Founders Memberships will be offered.
3.2 Price Lock Guarantee
Your Founders Membership rate is locked for as long as your membership remains continuously active and in good standing. “Continuously active” means that you have not voluntarily cancelled, have not had your membership terminated for cause, and have not entered into sustained payment default (defined as two or more consecutive missed payments after notice under our dunning process in Section 7.3).
We will not increase your Founders rate for a minimum period of 12 months from the date your membership starts. After this initial 12-month period, we reserve the right to adjust the Founders rate by no more than the prevailing Consumer Price Index (CPI) rate published by the Office for National Statistics, with a minimum of 60 days’ written notice. If you do not accept the adjusted rate, you may cancel your membership without penalty before the adjustment takes effect.
3.3 Pausing and the Price Lock
Pausing your Founders Membership in accordance with Section 6 does not forfeit your Founders rate. Your membership remains continuously active during a pause and the price lock is preserved.
3.4 Founders Benefits
In addition to the locked rate, Founders Members receive the following benefits:
We reserve the right to modify or add Founders benefits with 30 days’ notice. We will not remove a core benefit (priority booking or the price lock) without your explicit consent.
3.5 Transferability
Founders Memberships are personal to the individual named on the account. They are non-transferable and may not be sold, assigned, or gifted to another person.
3.6 Loss of Founders Status
Your Founders rate and associated benefits will be forfeited only in the following circumstances:
If you lose your Founders status and subsequently wish to rejoin, you will be offered a Standard Membership at the prevailing rate. Founders status cannot be reinstated once forfeited.
4. Auto-Renewal
All memberships renew automatically at the end of each billing period unless you cancel before your next Billing Date. The renewal will be at the same rate and on the same terms, unless we have given you notice of a change in accordance with these Terms.
We will send you a renewal reminder by email at least 7 days before your next Billing Date. This reminder will confirm your renewal date, the amount to be charged, and how to cancel. It will be sent as a standalone communication, separate from any marketing emails.
5. Cancellation
5.1 Cooling-Off Period
If you purchase your membership online, via our app, or at a distance (i.e. not face-to-face at the Studio), you have a statutory right to cancel within 14 days of the day after your purchase for any reason. If you have used any classes during this period, we will refund your membership fee less a pro-rata amount for the classes attended. If you have not used any classes, you will receive a full refund.

5.2 Cancellation After the Cooling-Off Period
You may cancel your membership at any time by:
Cancellations take effect at the end of your current paid billing period. You will retain access to classes until that date. We do not offer refunds for the remaining days of a billing period already paid for, except where required by law.
We will confirm your cancellation in writing by email within 2 business days, stating the effective cancellation date and your final Billing Date.
5.3 Cancellation of Standard Memberships During Minimum Term
If you cancel a Standard Membership before the end of your 3-month minimum commitment period, an early termination fee will apply as described in Section 2.3. This fee is a genuine pre-estimate of our loss and is not a penalty.
5.4 Hardship Cancellation
We recognise that unexpected life events can make it difficult or impossible to continue your membership. If you experience any of the following, you may request an early cancellation without an early termination fee:

6. Pausing Your Membership
You may pause your membership at any time, subject to the following terms:
6.1 Medical Pause
If you are unable to attend classes due to illness or injury, you may request a medical pause of up to 3 months by providing a letter from your GP or medical professional. Medical pauses are complimentary and do not count towards your annual pause allowance. We may grant extensions beyond 3 months at our discretion.
7. Payments and Refunds
7.1 Refunds
We do not generally offer refunds on memberships, class packs, or unused classes outside of the circumstances described in these Terms. However, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable legislation.
In particular, you have the right to a refund if:
7.2 Class Pack Validity and Expiry
Class packs must be used within the validity period stated at the time of purchase. Unused classes do not roll over, are not refundable, and are not transferable to another person. If you are unable to use your class pack due to circumstances covered by Section 5.4, please contact us and we will consider extending the validity period or providing a credit on a case-by-case basis.
7.3 Failed Payments
If a scheduled payment fails, we will follow this process:
We will always attempt to contact you before cancelling your membership and will make reasonable efforts to work with you if you are experiencing financial difficulty.
8. Class Bookings
Classes are capped in size for safety and experience. We strongly recommend booking in advance via our app or website. Bookings open 28 days in advance.
If a class is full, you may join the waitlist. You will be notified if a space becomes available. Joining the waitlist does not automatically book you into the class; you will need to confirm your spot when notified.
8.1 Cancellations and No-Shows
Please cancel at least 12 hours before your class start time so that others on the waitlist have the opportunity to take your place.
Class Pack Holders:
•No-show: a £15 no-show fee will be charged.
For your first late cancellation or no-show in any 30-day period, we will issue a courtesy reminder with no charge or credit loss. Subsequent occurrences within the same 30-day period will attract the fees or credit losses described above. No-show and late cancellation fees are capped at £60 per member per calendar month.
8.2 Arriving Late
Please arrive at least 5 minutes before your class begins. Late entry can disrupt the session and may pose a safety risk, particularly for reformer classes. For safety reasons, we may be unable to admit you once the class has started. If you know you are running late, please contact us and we will do our best to accommodate you where it is safe to do so.
9. Health and Safety
9.1 Consent to Exercise
By attending a class at MOVA Studios, you confirm that:
You are in good physical health and have no medical condition that would prevent safe participation in physical exercise, or you have disclosed any relevant conditions to us.
•You will inform your instructor of any injuries, health conditions, or concerns before each class.
•If you are pregnant, returning from injury, or have a pre-existing medical condition, you have sought and received clearance from a qualified medical professional before attending.
9.2 Equipment
You are responsible for using studio equipment safely and in accordance with your instructor’s guidance. Our equipment (including reformer machines, springs, and accessories) is specialist and should not be adjusted without instruction. If you are unsure how to use any equipment, please ask your instructor before use.
9.3 Liability
Physical exercise, including Pilates, reformer training, and yoga, carries inherent risks including (but not limited to) muscle strain, joint injury, and falls. By participating in classes at MOVA Studios, you acknowledge these risks and agree to take responsibility for your own safety, including by disclosing relevant health information and following instructor guidance.
MOVA Studios Limited accepts liability for death or personal injury caused by our negligence or the negligence of our employees or agents. We do not exclude or limit our liability where it would be unlawful to do so.
Subject to the above, MOVA Studios Limited is not liable for any injury, loss, or damage arising from your participation in classes or use of our facilities, except where caused by our negligence or breach of duty.
9.4 Age Requirement
All clients must be 18 years of age or over to attend classes at MOVA Studios. We may request proof of age at any time.
10. Personal Belongings
Please keep your belongings secure at all times. We recommend not bringing valuables to the Studio. MOVA Studios Limited does not accept responsibility for the loss, theft, or damage of personal items on our premises, except where caused by our negligence.
11. Conduct and Right to Refuse
We are committed to maintaining a safe, welcoming, and respectful environment for all members, staff, and instructors.
•Fails to resolve payment arrears within the process set out in Section 7.3.
Where we suspend or terminate a membership for cause, we will notify you in writing with the reasons for our decision. Termination for cause does not entitle you to a refund of fees already paid.
12. Changes to Terms, Pricing and Services
13.1 Changes to These Terms
We may update these Terms and Conditions from time to time. We will give you at least 30 days’ written notice of any material change that affects your rights, obligations, or the cost of your membership. If a material change is adverse to you, you may cancel your membership without penalty before the change takes effect.
Minor or administrative changes (such as corrections, clarifications, or changes required by law) may be made without notice.
For Founders Members: any change that affects the price lock guarantee, core Founders benefits, or Founders eligibility terms will require your explicit written consent and will not take effect by deemed acceptance.
13.2 Changes to Classes and Services
We reserve the right to update class times, instructors, formats, workshops, or events. Where reasonably practicable, we will give advance notice of changes via our app, website, or email. Temporary changes such as instructor substitutions may be made without notice.
13.3 Pricing Changes (Standard Members)
We will give you at least 30 days’ written notice of any change to your membership price. If you do not accept the new price, you may cancel your membership without penalty before the price change takes effect.
13.4 Force Majeure
We will not be liable for any failure or delay in providing our services where such failure or delay results from circumstances beyond our reasonable control, including (but not limited to) pandemic, epidemic, government restrictions, fire, flood, severe weather, utility failure, or industrial action.
In the event that a force majeure event prevents us from operating the Studio for a continuous period of more than 7 days, we will:
•Extend your membership by the duration of the closure at no cost; or
•Offer you the option to cancel your membership and receive a pro-rata refund for the period of closure.
We will notify you as soon as reasonably practicable of any closure and the options available to you.
14. Intellectual Property
All content, branding, design, class programmes, imagery, and written materials associated with MOVA Studios are the intellectual property of MOVA Studios Limited (or our licensors). You may not reproduce, distribute, or commercially use any of our materials without our prior written consent.
15. Data Protection
We take your privacy seriously. We collect and process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
We will not sell your personal data or share it with third parties for their marketing purposes without your explicit consent. We may share your data with third-party service providers (such as payment processors and booking software providers) who process data on our behalf and are bound by appropriate data protection obligations.
You have the right to access, rectify, erase, restrict, or port your personal data, and to withdraw consent where applicable. To exercise any of your data rights, contact us at [email protected].
16. Communications
We will communicate with you about your membership (including billing confirmations, renewal reminders, class updates, and service notices) via email and/or app notifications. Please keep your contact details up to date in your account.
Marketing communications will only be sent with your consent. You may unsubscribe at any time using the link in any marketing email or by contacting us.
17. Complaints
We want every experience at MOVA Studios to be a positive one. If you have a complaint, please let us know so we can resolve it quickly and fairly.
18.1 How to Complain
Please contact us at [email protected] with details of your complaint. We will acknowledge it within 2 business days and aim to provide a full written response within 10 business days. If more time is needed, we will let you know and provide a revised timeline.
18.2 Escalation
If you are not satisfied with our initial response, you may request that your complaint is escalated to a senior member of the team. We will provide a final written response within 10 business days of the escalation request.
18.3 Legal Remedies
If we are unable to resolve your complaint through our internal process, you retain the right to pursue your claim through the courts of England and Wales. You may also contact Citizens Advice (www.citizensadvice.org.uk) for guidance on your consumer rights.
18. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising from or relating to these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions will continue in full force and effect.
20. Entire Agreement
These Terms and Conditions, together with any membership-specific terms provided at the point of purchase, constitute the entire agreement between you and MOVA Studios Limited in respect of your membership and use of the Studio.
